Commercial Property Insurance

Georgia commercial property insurance

Carriers price Georgia property against hail, tornado and hurricane. Rate filings and the admitted market run through the Georgia Office of Commissioner of Insurance and Safety Fire, and the surplus lines route around it.

For a well maintained apartment, hotel or senior living property, Georgia is one of the easier Southeastern states in which to buy commercial property insurance: carriers are writing the business, and price follows hail losses rather than a retreat from the state. The pressure in Georgia has been on the liability side, where negligent security claims in metro Atlanta became one of the largest drivers of habitational liability cost in the country.

That is starting to change. The tort package the legislature passed in 2025 tightened the standard for holding a property owner liable for criminal acts by third parties on the premises and limited how damages figures can be anchored in closing argument. Owners should expect that benefit to arrive over several renewals rather than at the next one. Meanwhile the property exposure shifts across the state, from hurricane on the coast to hail and tornado through the middle to water damage in Atlanta. This page covers how Georgia regulates insurance and fire safety together, what the state's valued policy statute does not do for a commercial owner, and how we place the four classes we specialize in.

Who regulates property insurance in Georgia

Georgia Office of Commissioner of Insurance and Safety Fire

Georgia combines insurance regulation and the state fire marshal function in one elected office, which is unusual. The practical effect for commercial property owners is that the same agency that regulates your carrier also sets and enforces the fire safety code your building is inspected against. For senior living operators and hotels, the Safety Fire Division's inspection findings can surface in an underwriting file.

Fire inspections, a statute that stops at the house, and the residual market

Because Georgia's insurance regulator and its fire marshal are the same office, a fire inspection on a senior living community or hotel is also, in effect, part of the insurance file. Findings on sprinklers, egress and life safety, particularly where residents cannot evacuate on their own, can surface when an underwriter builds the risk picture. The practical step is simple and often skipped: clear open findings, and keep the paperwork showing they were cleared, before the renewal submission goes out. It is one of the few things that improves a Georgia renewal that costs nothing but attention.

Owners who have heard that Georgia has a valued policy law sometimes assume it protects their building. As the law notes below explain, it does not reach commercial property at all. For an apartment, hotel or senior living owner, the only protection against being underinsured on a total loss is getting the values right in advance, so we review replacement cost on every Georgia schedule at every renewal rather than letting last year's figures roll forward with an inflation factor.

When the admitted market will not write a property, Georgia offers two further routes. Surplus lines carriers write most of the coastal wind, older habitational and negligent security affected hotel risk the admitted market declines, after the documented declinations the state requires. Beyond that, the Georgia Underwriting Association acts as the residual market where no voluntary carrier will take the building. Knowing which route a property belongs on before marketing it saves time and avoids declinations that follow a submission around.

What carriers underwrite for in Georgia

  • Hail
  • Tornado
  • Hurricane
  • Straight line wind
  • Flood
  • Winter storm
Georgia's exposure changes as you move inland. The coastal counties around Savannah and Brunswick carry hurricane and storm surge risk and often draw separate named storm deductibles. Through the middle of the state, severe convective storm dominates, with hail and tornado accounting for most commercial property loss. Metro Atlanta has the largest concentration of apartment and hotel inventory in the Southeast and is underwritten mainly against wind, hail and water damage rather than against a named storm. Remnants of Gulf and Atlantic systems reach well inland and produce flooding along the Chattahoochee, Flint and Ocmulgee corridors, which is excluded from the property form. Winter storm is infrequent but produces outsized freeze and burst pipe losses when it arrives, because building systems in the state are not built for sustained cold.

From the coast to Atlanta: wind, hail, water and freeze

On the coast, the practical question is the separate named storm deductible described above, and whether the owner has planned to fund it. Expect an underwriter to ask for roof age, roof deck attachment and opening protection before quoting a coastal building. Flood, including surge, stays outside the property form and is placed separately.

Inland, the exposure described above becomes a hail, wind and water damage question, and Atlanta owners should expect their submissions to be read that way rather than against a named storm. The river flooding that tropical remnants bring inland is the item most often missed: a building along one of those corridors, hundreds of miles from the coast, still needs a flood decision made on purpose.

For owners outside Atlanta and Savannah, the inland metros of Macon, Augusta, Columbus and Athens sit in that storm band and in some cases along those river corridors. A schedule that mixes coastal and inland buildings usually carries two deductible structures, a percentage named storm deductible on the coast and a flat deductible inland, and it is worth confirming on the declarations page that each building carries the one intended for it.

Winter storm is rare in Georgia, and that is exactly why it causes outsized losses. Building systems here are not designed for sustained cold, so when a hard freeze arrives it produces burst pipe claims across whole portfolios at once. The structure of a Georgia program is commercial property coverage for the building and business interruption insurance for the income, sized for the time a storm or freeze really keeps units or rooms offline.

On liability, the negligent security question is the one underwriters still ask about in detail: lighting, access control, camera coverage and police call history on the property. The 2025 changes help, but a well documented security program remains the best evidence an owner can put in front of a general liability underwriter.

The Georgia market right now

Georgia has been a comparatively competitive property market by Southeastern standards, with capacity available for well maintained habitational and hospitality risk and pricing driven by hail loss development rather than by carrier withdrawal. The larger recent shift is on the liability side. The tort package the legislature passed in 2025 changed how premises liability claims are argued, including limits on anchoring damages figures in closing argument and tightened standards for holding a property owner liable for third party criminal acts on the premises. That last piece matters directly to apartment and hotel owners in metro Atlanta, where negligent security claims had become one of the largest drivers of habitational liability cost in the country. Carriers have not fully repriced for it yet, so the benefit shows up gradually at renewal rather than immediately. Current as of August 2026.

State law worth knowing in Georgia

Georgia has a valued policy statute, but it is written for one and two family dwellings and limited to fire, so it provides no protection to commercial property. A Georgia apartment, hotel or senior living owner settles a total loss on the policy's own valuation terms, which makes replacement cost adequacy and annual valuation review the protection the statute does not provide.

Admitted and surplus lines in Georgia

Surplus lines placements are filed with the Georgia Office of Commissioner of Insurance, with premium tax payable to the state. Georgia requires a diligent effort showing admitted market declinations for most surplus lines business. Coastal wind, older habitational schedules and hotels with negligent security loss history are the classes most likely to require a surplus lines market. The Georgia Underwriting Association functions as the state's residual property market where no voluntary market is available.

Insurance requirements when the loan is HUD, Fannie or Freddie

Fannie Mae and Freddie Mac multifamily loans on Georgia assets follow standard agency requirements for replacement cost valuation and deductible caps. On coastal properties, confirm the named storm deductible against the agency limits before binding. HUD Section 232 borrowers operating skilled nursing and assisted living in Georgia work under Department of Community Health licensing, and lenders on those assets typically want professional liability limits set with the metro Atlanta venue in mind rather than a statewide average.

Georgia pressures on the four classes

Each of our four classes meets a different part of the Georgia picture.

Senior living

For financed facilities, the lender expectations on professional liability set out in the financing section above mean the limit should be chosen with the Atlanta venue in mind. Safety Fire inspection findings on life safety systems matter more here than in almost any other class. The class overview is at senior living insurance.

Apartments

Metro Atlanta apartment owners are the owners the 2025 tort changes were most likely to help, since negligent security claims were concentrated on habitational property. On financing, Fannie Mae and Freddie Mac loans follow the standard agency rules, and on coastal property the named storm deductible should be checked against the agency caps before binding. Our apartment insurance page covers the class across the country.

Hotels

Hotels share the negligent security exposure with apartments, and a hotel with that loss history is a likely surplus lines placement. Coastal hotels add the named storm deductible. See hotel insurance across the country for the rest of the class.

Car washes

A car wash in central Georgia faces hail on the building and the occasional hard freeze on water lines and equipment. Mechanical breakdown is a separate peril from the property form, which is why equipment breakdown insurance belongs on the schedule, and a wash that cannot run loses its revenue the same day, so the income limit deserves the same care. Car washes in other states are on the car wash insurance class page.

What we need to quote a Georgia property

A Georgia submission needs the building, the location and, for habitational and hospitality risk, the security picture.

  • The current declarations pages for property and liability, with all endorsements.
  • A schedule of values with replacement cost by building, reviewed within the last year.
  • Roof age and construction class by building, plus roof deck attachment and opening protection for coastal locations.
  • Five years of loss runs, with any premises liability or negligent security claims identified.
  • A summary of security measures: lighting, access control, cameras and any on site staff.
  • For senior living and hotels, the most recent Safety Fire inspection and the status of any findings.

Making the most of a changing Georgia market

The 2025 tort changes are an opportunity that will not arrive on its own. Carriers reprice gradually, and the owners who benefit first are the ones whose submissions show a documented security program, cleared inspection findings and current values. We build Georgia files to make that case, and we tell you plainly when a loss history means the improvement is still a renewal or two away.

We place commercial property and liability for senior living, apartment, hotel and car wash owners across Georgia, using admitted, surplus lines and residual markets together. Questions

Georgia property insurance questions

What is a negligent security claim and why does it affect my Georgia apartment insurance?

It is a claim that a property owner failed to provide reasonable security and that the failure allowed a criminal act against a tenant or guest to occur. Metro Atlanta produced a run of large verdicts on this theory, and it became one of the biggest cost drivers on Georgia habitational and hospitality liability. The 2025 tort changes tightened the standard, but underwriters still ask about lighting, access control, camera coverage and police call history on the property.

Does a Georgia coastal property need a separate windstorm policy?

Not usually a separate policy, but expect a separate percentage named storm deductible on the coastal counties, and expect the underwriter to ask for roof age, roof deck attachment and opening protection details before quoting. Flood remains excluded and is handled separately.

Does the Safety Fire Division affect my insurance?

Indirectly and more than owners expect. Fire marshal inspection findings on a senior living community or hotel become part of the risk picture an underwriter builds, particularly around sprinkler systems, egress and life safety in occupancies with residents who cannot self evacuate. Clearing findings promptly is worth doing before a renewal submission goes out.
